The present general conditions of use aim at the legal framework of the modalities of provision of the services of the site www.avtransformation.com and their use by the “User”.

The general conditions of use must be accepted by any User wishing to access the site. They constitute the contract between the site and the User. Access to the site by the User means acceptance of these terms and conditions of use.

In case of non-acceptance of the general conditions of use stipulated in this contract, the User must renounce access to the services offered by the site.

www.avtransformation.com reserves the right to modify unilaterally and at any time the content of these general conditions of use.

Definitions

The purpose of this clause is to define the various essential terms of the contract:

User: this term refers to any person who uses the site or any of the services offered by the site.
User content: this is the data transmitted by the User within the site.

Accommodation

The host of the site is Likuid.ca, a North American company among the best, whose equipment is reliable and offers a quality service.

The site is secure, which means the site has a valid private SSL certificate from RapidSSL, a reputable supplier.

Terms of Service

This site has been optimized for current versions of Mozilla Firefox, Internet Explorer and Google Chrome browsers.

The site www.avtransformation.com is in principle accessible to the users 24 / 24h, 7 / 7d, except interruption, programmed or not, for the needs of its maintenance or case of force majeure. In case of impossibility of access to the service, SPCTE undertakes to do its utmost to restore access to the service and will then endeavor to communicate to users the dates and times of the intervention. Being subject only to an obligation of means, SPCTE can not be held responsible for any damage, whatever its nature, resulting from unavailability of the service.

The site allows the User free access to the following services:

  • News articles and videos;
  • Publication of comments;
  • Free gift (s) in force;
  • Website spcte.com.

The site is accessible free of charge to any user with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at his expense.

Terms of use

SPCTE operates the Site from its offices in Canada. SPCTE makes no representations that elements of the Site may be used in locations other than Canada and it is prohibited to access the Site from territories where legislation would require that the content or use be of the Site is illegal. Those who choose to use the Site do so on their own initiative and it is their responsibility to comply with all applicable local laws. Any claim relating to the Site and the elements it contains, or arising from the use of the Site, is governed by the laws applicable in the territory of the Province of Quebec.

Responsibility

SPCTE endeavors to provide as accurate information as possible and the sources of information posted on the site are deemed reliable. However, the site can not be held responsible for omissions, inaccuracies and deficiencies in the update, whether by him or the third party partners who provide this information. The information given on the site is for informational purposes only. Thus, the User assumes sole responsibility for the use of the information and contents of this site.

Hypertext links and references of third parties

Many outgoing hypertext links are present on the site, however the web pages where these links lead do not engage the responsibility of SPCTE who does not have control of these links.

The User is therefore prohibited to engage the responsibility of the site concerning the content and the resources relating to these outgoing hypertext links.

Intellectual property

The trademarks, logos, signs and other content of the site are protected by copyright.

The User requests the prior authorization of the site for any reproduction, publication, copy of the various contents.

The User agrees to use the contents of the site in a strictly private setting. Use of the content for commercial purposes is strictly prohibited.

Any content posted by the User is his sole responsibility. The User agrees not to put online content that may affect the interests of third parties. Any legal action brought by an injured third party against the site will be borne by the User.

The content of the User may be at any time and for any reason deleted or modified by the site. The User receives no justification and notification prior to the deletion or modification of the User Content.

Terms and conditions

1.Accepting an order

The receipt by email of the confirmation of an order does not automatically mean that SPCTE accepts the said order and is not a confirmation that SPCTE is committed to selling anything. SPCTE reserves the right, without further notice, to refuse to do business with any customer and / or to set a quantity limit for any item in an order. It may be necessary for SPCTE, at any time, to verify personal information before accepting any order.

2. Price

The price payable for each product you order is the one appearing next to each product offered on the Site.

Shipping, delivery charges and applicable sales taxes, are extra.

SPCTE reserves the right to modify at any time the price of products offered on the Site, without notice.

All prices are in Canadian dollars. The prices of products on the Site may differ from the prices offered for the same products in the bookstores.

3. Product returns

  • Virtual products

Please note that no returns or refunds are applicable for a virtual product to download or view as it is in your possession immediately after purchase.

  • Physical products

You may return products to SPCTE at any time until the end of the 10th day following receipt at the following address: 9 Vale Perkins St, Postal Box 897, Mansonville, (Quebec) Canada, J0E 1X0. The products must be accompanied by the invoice and the order number. You must provide a justification to SPCTE in such a case.

You will be responsible for shipping and risk for returned products (unless SPCTE has not delivered the products you ordered or delivered damaged or defective products), in which case SPCTE will cover transportation costs and risks, to the extent that you return the products through an economical postal service.

Please note that we do not refund products that have been removed from their original packaging or, in the case of books, when they are damaged or when the cover is folded, unless the products are defective. If an item is defective and returned within 30 days of its purchase, it will be exchanged for a new copy of that same product.

Upon receipt of returned products, SPCTE Inc. will reimburse the amount disbursed to you except the delivery charges, by sending a check by mail as soon as possible, provided, however, that the returned goods have been returned by you and received by SPCTE in the same condition as they were when they were delivered to you.

4. Availability of products

In the event that SPCTE must wait for one or more out of stock items to become available, it may be that your order is held before being shipped.

SPCTE does not guarantee in any case the availability of the products offered on the Site. If SPCTE can not deliver to you any of the products that you have ordered due to a shortage of stock, SPCTE will notify you by e-mail when the products ordered which do not were not in stock will become. In which case you will have the following options:

  • Request that the products be delivered to you, in which case a payment will be taken from your Paypal account or your check will be cashed, as the case may be, for these products, before the products are delivered to you;
  • Refuse that you are given these products, in which case no payment will be taken from your Paypal account for these products or your check will be destroyed.

SPCTE will not be liable for any damages you may have suffered due to out of stock.

5. Delivery of products

SPCTE will deliver the products ordered by you to the address you have given when placing your order.

Delivery charges correspond to a product ordered.

Delivery will be made by SPCTE Inc. as soon as possible after the acceptance of your order.

You will become the owner of the products you ordered when they are delivered by SPCTE to the transportation company. From then on, you will have to assume the risks and SPCTE will not be responsible for their loss or destruction.

For any product delivered outside of Canada, you are responsible for all costs associated with customs clearance and any other costs associated with exporting outside of Canada.

The delivery of the products is subject to the rules of the delivery companies with which SPCTE does business, in this case, Canada Post, as well as the rules of any other company with which SPCTE Inc. may do business from time to time. In particular, you are subject to the rules concerning the signing of an acknowledgment of receipt of the products, if applicable. If you are away from where you asked SPCTE to deliver the products to you, it will be your responsibility to recover the products according to the rules of the delivery company.

SPCTE must have received full payment for the products to be delivered to you before proceeding with their delivery.

6. Content subject to a registration

Certain content and/or services of the Site may be offered to you subject to your registration. If you choose to acquire content and/or services subject to registration, you certify that you are at least 18 years old, that all the information you submit is accurate and truthful and that you agree to pay all fees and all related taxes. You can under no circumstances be refunded for the online purchase of any virtual product. Your registration applies to you only. You may not transfer your account name and password to third parties or allow them to use them, including your office colleagues. Any broadcast of your account name and password may result in the cancellation of your subscription without any refund, with additional fees based on unauthorized use.

7. Events

Certain contents of the Site can be proposed to you in the form of events. If you choose to register and you send to SPCTE a request to this effect, you certify that you are at least 18 years old, that all the information you submit is accurate and truthful (including, inter alia, the number of your credit card and its expiry date), and that you agree to pay all the costs to you and all related taxes.

Please note that all coachings, workshops and trainings are subject to the law favoring the development and recognition of skills of the workforce of Quebec (1%).

In case of cancellation of an event, participants will be notified ten (10) days before the event. The participant will have the choice between participating in the next scheduled event or being reimbursed.

For any cancellation of registration, you must send your request* by email 14 days or more before the event for a full refund (administration fees may apply). If a cancellation occurs after this time, 50% of the registration fee will be refunded up to 4 days before the event and no refund 3 days or less before the event. The replacement of a participant by a friend or colleague is accepted without charge however, you must not transmit your information or access to your replacement. You must contact SPCTE no later than 24 hours before the date of the event to inform them of your alternate’s contact information.

*The request must include the title, the date and the location of the event.

8. Liability

In the event that the responsibility of SPCTE may be withheld from you, it will be limited to an amount of money equal to the price you paid for the returned products. Notwithstanding the foregoing, nothing in this section shall have the effect of limiting any right you may have as a consumer under any of the public policy laws that may be applicable in your case.

9. Force majeure

SPCTE will not be liable for the non-performance, in whole or in part, of any of its obligations to you, or any damages or losses you may incur, if the breach, damage or loss results from a case of force majeure or circumstance beyond its control.

Publication by the User

The site allows members to post comments.

In his publications, the member undertakes to respect the rules of the Netiquette and the rules of law in force. The site exercises a moderation a priori/a posteriori on the publications and reserves the right to refuse their putting online, without having to justify it to the member.

The member remains the owner of all his intellectual property rights. But by publishing a publication on the site, it assigns to the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, distribute and distribute its publication, directly or by an authorized third party, throughout the world, on any support (digital or physical), for the duration of the intellectual property. The Member assigns in particular the right to use its publication on the internet and on the mobile networks.

The site agrees to include the name of the member near each use of its publication.

Evolution of the contract

Duration

The duration of this contract is indefinite. The contract has effect with respect to the User from the use of the service.

Interpretation

The User understands and accepts the pricing, the regulations and all the clauses mentioned above.

Applicable right

Both this site and the terms and conditions of its use are governed by the rights of Quebec and Canada regardless of the place of use. In the event of any dispute, and after the failure of any attempt to find an amicable solution, the Quebec/Canadian courts will have exclusive jurisdiction to hear the dispute.
