The purpose of these general terms and conditions of use is to provide a legal framework for the terms and conditions under which the services of the www.spcte.com website are made available and used by the “User”.<\/span><\/p>\n

The general terms and conditions of use must be accepted by any User wishing to access the site. They constitute the contract between the site and the User. Access to the site by the User implies acceptance of these general conditions of use.<\/span><\/p>\n

In the event of non-acceptance of the general conditions of use stipulated in this contract, the User must renounce access to the services offered by the site.<\/span><\/p>\n

The site is secure, i.e. it has a valid private SSL certificate from RapidSSL, a reputable supplier.<\/span><\/p>\n

Terms and conditions of use<\/strong><\/span><\/p>\n

This site has been optimized for current versions of Mozilla Firefox,Safari and Google Chrome browsers.<\/span><\/p>\n

In principle, the spcte.com website is accessible to users 24 hours a day, 7 days a week, unless it is interrupted, whether scheduled or not, for maintenance purposes or in the event of force majeure. Should access to the service prove impossible, SPCTE Inc. undertakes to do its utmost to restore access to the service and will endeavour to inform users of the dates and times of the intervention in advance. As SPCTE Inc. is subject only to an obligation of means, it may not be held liable for any damage whatsoever resulting from the unavailability of the service.<\/span><\/p>\n

SPCTE Inc. does not guarantee that the site will be free from errors, interruptions, or technical incidents and shall not be held liable for inconveniences inherent to the use of the Internet, including service outages, intrusions, or the presence of viruses.<\/span><\/p>\n

Confidentiality and protection of personal information<\/strong><\/span><\/p>\n

The processing of personal information is governed by SPCTE Inc.\u2019s Privacy Policy, in compliance with Qu\u00e9bec\u2019s Law 25.<\/span><\/p>\n

By using the site, the user consents to the collection, use, and retention of their personal information in accordance with that policy.<\/span><\/p>\n

Liability<\/strong><\/span><\/p>\n

SPCTE Inc. endeavours to provide information that is as accurate as possible and the sources of the information published on the site are deemed reliable. Nevertheless, the site may not be held liable for omissions, inaccuracies, or failure to update information, whether caused by SPCTE or by third-party partners who provide such information. The User’s content may be deleted or modified by the site at any time and for any reason. The User does not receive any justification or notification prior to the deletion or modification of User content.<\/span><\/p>\n

1 Acceptance of an order<\/span><\/p>\n

Receipt by email of confirmation of an order does not automatically signify acceptance of the order by SPCTE Inc. and is not confirmation that SPCTE Inc. undertakes to sell anything. SPCTE Inc. reserves the right, without further notice, to refuse to do business with any customer and\/or to set a quantity limit for any item in an order. It may be necessary for SPCTE Inc. at any time to verify personal information before accepting any order.<\/span><\/p>\n

2. Price<\/span><\/p>\n

The price payable for each product or service you order is the price appearing next to each product offered on the Site.<\/span><\/p>\n

Shipping and delivery charges, as well as applicable sales taxes, are extra.<\/span><\/p>\n

SPCTE Inc. reserves the right to change the prices of products and services offered on the Site at any time without notice.<\/span><\/p>\n

All prices are in Canadian dollars. The prices of products on the Site may differ from the prices offered for the same products in bookstores.<\/span><\/p>\n

3. Product returns<\/span><\/p>\n

Virtual products<\/span>
\nNo returns, exchanges, or refunds apply to virtual, digital, downloadable, or viewable products, as they are deemed delivered and consumed upon purchase.<\/span><\/p>\n

In the event of a technical error preventing access or download, SPCTE Inc. undertakes to restore access or provide a replacement file at no cost.<\/span><\/p>\n

Physical products<\/span>
\nYou may return products to SPCTE Inc. at any time until the end of the 10th day following their receipt at the following address: 9 Vale Perkins Street, P.O. Box 897, Mansonville, Qc, Canada, J0E 1X0. Products must be accompanied by the invoice and order number. You must provide justification to SPCTE in such cases.<\/span><\/p>\n

You will be responsible for the cost of delivery and risk of returned products (unless SPCTE Inc. failed to deliver the products you ordered or delivered damaged or defective products), in which case SPCTE Inc. will assume the cost of transportation and risk, provided you return the products using an economical postal service.<\/span><\/p>\n

Please note that we will not refund products that have been removed from their original packaging or, in the case of books, where the packaging is damaged or the cover is bent, unless the products are faulty. If an item is faulty and returned within 30 days of purchase, it will be exchanged for a new copy of the same product.<\/span><\/p>\n

On receipt of the returned products, SPCTE Inc. will reimburse you for the amount paid, excluding delivery costs, by sending a cheque by post as soon as possible, provided that the products being returned have been returned by you and received by SPCTE Inc. in the same condition as when they were delivered to you.<\/span><\/p>\n

4. Availability of products<\/span><\/p>\n

In the event that SPCTE Inc. has to wait for one or more out-of-stock items to become available, your order may be held back before being dispatched.<\/span><\/p>\n

SPCTE Inc. in no way guarantees the availability of the products offered on the Site. If SPCTE Inc. is unable to deliver any of the products you have ordered due to stock shortages, SPCTE Inc. will notify you by email when the products ordered that were not in stock become available. You will then have the following options:<\/span><\/p>\n

Request delivery of the products, in which case a payment will be taken from your PayPal account or your Interac e-Transfer will be deposited, as the case may be, for these products, before the products are delivered to you;<\/span>
\nRefuse delivery of these products, in which case no payment will be taken from your PayPal account for these products or your e-Transfer will not be accepted.<\/span><\/p>\n

SPCTE Inc. will not be liable at any time for any damages you may suffer as a result of a product being out of stock.<\/span><\/p>\n

5. Delivery of products<\/span><\/p>\n

SPCTE Inc. will deliver the products ordered by you to the address you provided when you placed your order.<\/span><\/p>\n

Delivery charges are per product ordered.<\/span><\/p>\n

Delivery will be made by SPCTE Inc. as soon as possible after acceptance of your order.<\/span><\/p>\n

You will become the owner of the products you have ordered when they are handed over by SPCTE Inc. to the transport company. From that moment onwards, you will be required to assume the risks and SPCTE Inc. will not be responsible for their loss or destruction.<\/span><\/p>\n

For any product delivered outside of Canada, you are responsible for all customs clearance fees and any other fees associated with exporting outside of Canada.<\/span><\/p>\n

The delivery of products is subject to the rules of the delivery companies with which SPCTE Inc. does business, in this case, Canada Post, as well as the rules of any other company with which SPCTE Inc. may do business from time to time. In particular, you are subject to the rules concerning the signing of an acknowledgement of receipt of products, where applicable. If you are absent from the place where you asked SPCTE Inc. to deliver the products to you, it will be your responsibility to collect the products in accordance with the rules of the delivery company.<\/span><\/p>\n

SPCTE Inc. must have received full payment for the products to be delivered to you before proceeding with their delivery.<\/span><\/p>\n

6. Content subject to registration<\/span><\/p>\n

Certain content and\/or services on the Site may be offered to you subject to registration. If you choose to purchase content and\/or services subject to registration, you certify that you are at least 18 years of age, that all information you submit is accurate and truthful and that you agree to pay all charges and taxes. Under no circumstances can you be reimbursed for the online purchase of any virtual product. Your subscription applies only to you. You may not transfer your account name and password to third parties or allow them to use them, including your office colleagues. Any disclosure by you of your account name and password may result in cancellation of your subscription without refund, together with additional charges based on unauthorised use.<\/span><\/p>\n

7. Events<\/span><\/p>\n

Certain content on the Site may be offered to you in the form of events. If you choose to register and you send SPCTE Inc. a request to this effect, you certify that you are at least 18 years old, that all the information you submit is accurate and true (including, in particular, your bank card number and its expiry date), and that you undertake to pay all the charges payable by you and any related taxes.<\/span><\/p>\n

Please note that all workshops, coaching and training sessions are subject to the Act to promote workforce skills development and recognition in Quebec (1%).<\/span><\/p>\n

If an event is cancelled, participants will be notified ten (10) days prior to the event. Participants will have the choice of attending the next scheduled event or receiving a refund.<\/span><\/p>\n

To cancel a registration with a full refund (administration fees may apply), you must send your request* by e-mail 14 days or more before the event. If a cancellation occurs after this deadline, 50% of the registration fee will be refunded up to four (4) days before the event and no refund will be made three (3) days or less before the event. The replacement of a participant by a friend or colleague is accepted free of charge, however, you must not transmit your information or access to your replacement. You must contact SPCTE at least 24 hours before the date of the event to inform them of your replacement’s contact details.<\/span><\/p>\n

For coaching appointments, a time slot will be reserved for you and must be respected. If you are absent, the consultation will not be rescheduled.<\/span><\/p>\n

*The application must state the title of the event, the date and the location.<\/span><\/p>\n

8. Liability<\/span><\/p>\n

SPCTE Inc.’s liability to you shall be limited to an amount of money equivalent to the price paid by you for the returned goods. Notwithstanding the foregoing, nothing in this section shall have the effect of limiting any rights you may have as a consumer under any public policy legislation that may be applicable to you.<\/span><\/p>\n

9. Force Majeure<\/span><\/p>\n

SPCTE Inc. will not be liable for the non-performance, in whole or in part, of any of its obligations to you, or for any damages or losses you may suffer, if the non-performance, damages or losses result from an event of force majeure or a circumstance beyond its control.<\/span><\/p>\n

Publication by the User<\/strong><\/span><\/p>\n

When the site allows members to publish comments :<\/span><\/p>\n

In their publications, members undertake to comply with the rules of Netiquette and the legal provisions in force.<\/span><\/p>\n

The site moderates publications a priori\/a posteriori and reserves the right to refuse to publish them online, without having to justify this to the member.<\/span><\/p>\n

Members retain full ownership of their intellectual property rights. However, by publishing a publication on the site, he\/she grants the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, broadcast and distribute his\/her publication, directly or through an authorised third party, throughout the world, on any medium (digital or physical), for the duration of the intellectual property. In particular, the Member transfers the right to use his or her publication on the Internet and mobile telephone networks.<\/span><\/p>\n

The site undertakes to include the Member’s name in the vicinity of each use of his or her publication.<\/span><\/p>\n

Changes to the contract<\/strong><\/span><\/p>\n

The site reserves the right to modify the clauses stipulated in this contract at any time.<\/span><\/p>\n

Any changes to these terms will be posted on this page with the date of the update. Users are encouraged to review this page regularly to stay informed of the current version.<\/span><\/p>\n

Duration<\/strong><\/span><\/p>\n

The duration of this contract is indefinite. The contract takes effect with regard to the User from the time of use of the service.<\/span><\/p>\n
